I know this was posted well over a year ago, but I just happened to come across it and felt a comment couldn't hurt.
...Actually donations on MCC games are not technically donations they are payments for premium features and are subject to tax / repayment if such items bought are not given or the user is not able to use.
First of all, they technically ARE donations since they are labeled as such, but you would need to obtain a "Not For Profit" business license to make them tax-exempt. Also, if people are made aware PRIOR to the transaction that it will be treated as a donation, then they can expect no warranties or guarantees.
Therefore it's illegal to shut down the website and the members surely who donated so much in them months to generate the high 1k he claims he made can take legal action against the owner of the game (immortal thug).
Now this one is hypothetical, but the point is still valid... Suppose you buy a set of tools from Craftsmen (all Craftsmen tools come with a lifetime warranty). If Craftsmen were to declare bankruptcy and go out of business, your lifetime warranty would be null and void. Are you suggesting that it would be illegal to shut down a business without first refunding ALL of your revenue generated throughout the course of the business' lifetime? Considering you are buying tools AND a lifetime warranty on said tools all in one transaction and for one set price, this is a valid question.
I'm not trying to give you a hard time, I'm only adding logical argument to your statements so that others may make their own decisions based on two opposing ideas.
